Patent and Utility Model Law, Law of Employee Inventions
Patents and utility models protect inventive technical products and processes. Disputes in this field are set up between two poles: on the one hand, protection of innovation; on the other hand, free enterprise and competition. Understanding of technical and business-related issues is as important in this field as in-depth knowledge of the special proceedings before the patent infringement courts (especially in Munich, Düsseldorf and Mannheim) and the interconnections with opposition and nullity proceedings before the German and European Patent Offices and the Federal Patents Court.

   Trademark Law
A firm name, a product name, a service mark, or an internet domain name can be an extremely valuable asset which often may have a higher value than technical know how, and even a higher value than the capital that has been invested. Planning, development, administration and enforcement of national and international trademark portfolios belong to our range of practice as well as trademark searches, trademark watch, and the efficient conduction of trademark infringement proceedings and counselling in trademark-related cases.

   Copyright Law, Design Patents
Copyright protection is not only relevant for items belonging to the fine arts such as paintings or operas. Applied arts such as advertising graphics and copy, popular music, design of consumer goods, and even computer software, are also suitable for copyright protection and can be subject to disputes of great importance.

   Unfair Competition Law
The whole variety of business life can be found in unfair competition cases. Comparative advertising, misleading, product imitation, price tags and much more can be subject to an unfair competition dispute. All types of business can be involved, car manufacturers, financial service, retailers, and, especially, new businesses such as e-Commerce firms and energy suppliers in the newly liberalised markets. All attorneys at KLAKA are active in this field.

   Press and Media Law
Press law has on the one hand to take care of the freedom of press and information, on the other hand it has to deal with the protection of individual personal rights. "Classic" press law deals mainly with claims for publishing remonstrances, and with claims to cease and desist. Furthermore, copyrights, publishing contracts and certain questions of unfair competition play a role.

   IT and Internet Law
This is not a category of law in itself. Today, however, problems requiring special IT know how arise in many different fields of law, e.g. copyright law, unfair competition law, trademark law, patent law, and in general civil contractual law as well. Furthermore, special legislation, e.g. the law regarding "tele services", have to be taken into account.

   Food and Drug Law
Energy drinks, baby nutrition, chocolate bars: with all kinds of food products, in all stages of product development and marketing, special legislation, EC-directives and the like have to be observed. Drug law is not only important in connection with "classical" medical drugs but has also to be taken into account when the question arises whether a food product has to be regarded as a drug because of the way it is advertised (e.g., if "fitness" is mentioned).

Antitrust and Public Procurement Law, Law of Power Supply
Mergers and acquisitions are not the only instances in which antitrust law does come into play. Nearly any license or distribution contract contains "traps" caused by antitrust law; and in connection with the infringement of protective rights as well as in many unfair competition cases, questions regarding German and EC antitrust law may play a role. New and of great importance are the regulations regarding public procurement. In the field of power supply, the special situation in the liberated market as well as very complex technical issues are relevant.
